Radar Enablement and Estimate Review

Before carrying out foreign trade operations, the importer and/or exporter must be qualified to operate in the Integrated Foreign Trade System (Siscomex), also known as RADAR (Registration and Tracking of the Performance of Customs Interveners). This procedure is governed by Normative Instruction RFB 1,984/2020.

Qualification must be requested through the Siscomex Single Portal via digital certificate (e-CPF).

If the company is duly qualified and wishes to change its operating limit, it is also possible to request a review of its financial capacity estimate via the Single Portal for the purpose of reclassification under another type of qualification or operating limit. If the system rejects the request, the request must be made via a digital dossier via the e-CAC portal, following the rules established by COANA Ordinance 72/2020.

Radar Enablement

Estimate Review

It is the reframing of the radar submodality, in simple terms, the change in the import limit.

The review can be carried out through the Siscomex Single Portal or via Process, as per COANA Ordinance No. 72/2020.

The importer must demonstrate his actual existence and his financial capacity.

CUSTOMS CLEARANCE

It is the tax procedure through which the accuracy of the data declared by the exporter or importer in relation to the exported or imported goods is verified to verify the accuracy of all the data declared in relation to the goods, documents and specific legislation.

EX-TARIFF

The Ex-Tariff regime consists of the temporary reduction of the import tax rate on capital goods (BK) and information technology and telecommunications (BIT), as set out in the Common External Tariff of Mercosur (TEC), when there is no equivalent national production.

Currently, the Ministry of Economy has promoted the reduction to 0% (zero), under the Ex-Tariff.

In other words, the Ex-Tariff regime promotes the attraction of investments in the country, since it exempts investments directed to productive enterprises. The importance of this regime consists of three fundamental points:

•Enables increased investment in capital goods (BK) and information technology and telecommunications (BIT) that do not have equivalent production in Brazil;

•It enables increased innovation by companies from different segments of the economy, with the incorporation of new technologies that do not exist in Brazil, with repercussions on the productivity and competitiveness of the productive sector;

•It produces a multiplier effect of employment and income on different segments of the national economy.

IMPORTATION OF USED MACHINERY OR EQUIPMENT

As a general rule, the import of machinery, equipment or any other used material is prohibited, however, as with every rule there is an exception, and this is no different.

By complying with the standards established by the Brazilian Federal Revenue Service, mainly DECEX Ordinances 08/1991 and 23/2011, it is possible to carry out the aforementioned imports, provided that they are previously authorized as determined by law.

The MEX Group seeks these authorizations and makes the mentioned imports possible.

SPECIAL CUSTOMS REGIMES

So called because they do not comply with the general rule of the common import and export regime.

Among them we can highlight some:

•Customs Transit: This is the regime that allows the transportation of goods, under customs control, from one point to another in the Customs Territory, with suspension of taxes;

•Drawback: The mechanism works as an incentive for Brazilian exports, by enabling the reduction of industrialization costs for exportable products, making them more competitive in the international market;

•Temporary Export: Temporary export is considered the departure from the country of national or nationalized goods, subject to reimportation within a specific period, in the same condition or after undergoing a repair, repair or restoration process;

•Temporary Admission: The special customs regime of temporary admission is the one that allows the import of goods that must remain in the country for a fixed period, with total or partial suspension of the payment of taxes applicable to the import;

•Customs Warehouse: This is the regime that allows, in imports and exports, the storage of goods in a specific location, with suspension of tax payments and under fiscal control. Partial nationalization is permitted and in accordance with the needs of each company;

•Other Special Customs Regimes: In their most varied forms, they have as a common characteristic the exception to the general rule of application of taxes required on the import of foreign goods or the export of national goods, in addition to the possibility of differentiated treatment in customs controls.

IMPORTATION ON BEHALF OF THIRD PARTIES

Importation on behalf of a third party is a service provided by a company - the importer (MEX TRADE) - which promotes, on its behalf, the Import Customs Clearance of goods acquired by another company or individual - the acquirer (Client) - due to a previously signed contract, which may also include the provision of other services related to the commercial transaction, such as price quotations and commercial intermediation.

Thus, in imports on behalf of and by order of the buyer, although the role of the importing company (MEX TRADE) may range from the simple execution of the import clearance to the intermediation of negotiations abroad, contracting of transport, insurance, among others, the actual importer is the purchaser (Client), the person ordering the import, the one who actually brings the goods from another country, due to the international purchase.

Therefore, even if the importer on behalf of and by order of the supplier (MEX TRADE) makes payments to the foreign supplier, whether in advance or not, this is not characterized as an operation on its own behalf, but rather between the foreign exporter and the purchaser (Client), as the financial resources originate from the latter.

The MEX Group, through its Importer MEX TRADE, makes the aforementioned imports possible, providing tax reductions, especially in relation to ICMS.

IMPORTATION BY ORDER

Import by order is when the trading company (MEX TRADE) acquires goods abroad with its own resources and promotes the import customs clearance.

In this situation, the objective of the importer (MEX TRADE) is to resell the products purchased to a previously determined company (Client), which orders the merchandise through a contract established between the parties.

The MEX Group, through its Importer MEX TRADE, makes operations viable, providing tax and operational reductions.

INTERNATIONAL SHIPPING

Working in Foreign Trade and not involving international transport services of goods between different countries is practically impossible.

International shipping is the sending of goods from one country to another following the export rules of the country of departure and the import rules of the destination country, in addition to international transport protocols.

There are several types (Modes) of International Transport.

“Modal” is the term used to mean “mode of transport” or “transportation modality” and, just like domestic deliveries, international shipping also has several modal options to choose from. They are:

•Sea transport;

•Air transport;

•Rail transport;

•Road transport; and

•Pipeline transport

SEA TRANSPORTATION

AIR TRANSPORTATION

It is the fastest and most agile form of transport, allowing the transport of all types of goods.

Although it is not one of the cheapest transport options, it is the fastest and highly recommended for high value-added goods, small volumes or urgent loads.

RAIL TRANSPORTATION

Just like the maritime modality, it allows the transportation of large volumes of goods of the most varied types.

Although it is not one of the most used forms of transport in Brazil for moving cargo across borders, the mode is used to transport goods to ports, within Brazil and abroad.

ROAD TRANSPORTATION

It is the most widely used method in the national territory, but it is not very different in international transport, especially with our neighboring countries, and it also allows the transport of large volumes of goods of the most varied types.

PIPELINE TRANSPORTATION

It is the transport method used through pipelines, used to transport fluids, such as oil and derivatives, natural gas and ethanol.
